Understanding the Timeline:

Initial application. The average response time for the SSA to reach a decision after you apply for SSDI benefits is four to six months, but this time period could be extended depending on the facts of your case, how quickly your doctors provide medical records and how busy the SSA is at any given point in the year. Unfortunately, most applications are denied.

Reconsideration:

If the SSA denies your request for benefits, you will need to file a request for reconsideration of their decision within 60 days. It could then take an additional four to six months to send you a decision on your initial appeal. Most reconsiderations are also denied.

Appeal:

If your request for reconsideration is denied, you will need to file an appeal within 60 days to ask for a hearing with an administrative law judge (ALJ). On average takes six to nine months before your hearing is scheduled and the ALJ makes a decision on your claim. The Five Steps to Qualify For SSDI or SSI Benefits

INTRODUCTION TO SSA’S SEQUENTIAL EVALUATION PROCESS

The Social Security Administration (SSA) has a five step process to determine if you qualify for SSDI benefits assuming you have enough work credits to be insured for SSDI benefits . There is a sixth step in the SSI benefit evaluation if you are not insured. The answers to these question determine whether the SSA will deny or grant your claim. Every case must go through this process.

FIRST STEP: ARE YOU WORKING?

The first step of the Social Security review process is really very simple. Are you working? While you are allowed to work a little bit and still claim to be disabled, the limits are fairly low. For 2024 the absolute most you can make per month before taxes is $1550. Above that and you are engaged in Substantial Gainful Activity (SGA) and they will not even look at your medical conditions.

Each year the SGA level goes up according to the cost of living. The SGA amount is higher for those who are blind. For example, SGA for statutorily blind people in 2024 is $2590.

Some people think that they can work and earn just under SGA and still be paid benefits. While technically, this is accurate, it doesn’t play out in reality. The judge thinks that if you can earn some money then you can earn just a little more money.

STEP TWO: DO YOU HAVE A “SEVERE” MEDICAL CONDITION?

If you have only a slight medical issue which has only a minimal effect on your ability to work, then your medical condition is “not severe.” If the SSA finds your condition is not severe, then they will find you are not disabled.

Therefore, to proceed through the SSA review process, you must show the SSA that you have a severe physical or mental condition or multiple minor conditions that, when combined, limit the work you could do. The SSA’s decision is based on medical opinions and exams from your doctor and the SSA’s doctors.

Some people have severe medical conditions but are still able to perform activities of daily living and work, because their condition is controlled by treatment. For example, if you have seizures but they are controlled by medications then your illness would not be severe. It is when symptoms do not respond to treatment that it becomes severe. And it is the symptoms which are disabling rather than the diagnosis itself.

There is also a durational requirement for SSDI / SSI. Your severe impairments have to prevent you from working (over SGA) for at least 12 full months although that does not mean you should wait 12 months to apply. Like many things in the law there are exceptions but they can be complicated which is one more reason to hire a good social security lawyer.

STEP THREE: DO YOU MEET OR EQUAL AN SSA LISTING?

At step three, the SSA will look to see if your medical condition meets or equals an SSA listing. The SSA has a list of medical conditions that qualify you for benefits. There are over a hundred specific physical and mental health conditions that qualify for SSDI and SSI benefits.

To be awarded benefits by the SSA, you must meet every element of the listing. This is hard to do so you must have very strong medical evidence. If you do not meet a listing, then a lawyer can argue that you equal a listing.

STEP FOUR: CAN YOU PERFORM YOUR PAST WORK?

Step four has two parts. The first thing the SSA asks is what is your residual functional capacity (RFC). Social Security will look at the jobs you’ve done over the last 5 years and make a determination, based on your RFC, as to whether or not you can do your past work.

If the SSA decides you can still do your past work as you actually did it, then they will find that you are not disabled, or
If the SSA decides you can do your past work as it is generally performed in the national economy, then they will find you are not disabled, or
If the SSA decides you are not physically and mentally able to do any of your past relevant work, either as you did it or as it is generally done in the national economy, then the SSA will move to step 5. Step five is the final step of the review process.

STEP FIVE: CAN YOU DO OTHER WORK?

At step 5, the burden of proof shifts to the SSA to prove that there are “other” jobs (besides your past jobs) that you can do. The SSA important factors include your age, education, work experience, and your RFC. The SSA does not consider whether you will be hired or can find a job. They are only interested in whether you are able to work.

The SSA uses of a set of tables known as the medical-vocational guidelines, or as lawyers call them, the “Grid Rules.” The older you are and the fewer work skills you have, the easier it is to win SSD benefits.

STEP SIX - SSI ONLY:

In order to receive SSI benefits, not only do you have to prove that you meet the medical requirements but you also have to meet the “non-medical” requirements. What is that? Money essentially. Since SSI is considered a type of welfare benefit, it has very strict and very low income and assets limitations. Those rules can also be complicated.

It isn’t easy to win Social Security benefits. Likewise, the five step review process is frustrating for most people. But having an attorney throughout the review process can make it easier and greatly improve your chances of success.

Work credits are based on your total wages for the year. If you work and pay Social Security taxes, for every $1,730 (in 2024) you make each quarter while working, you earn 1 work credit. You can earn up to 4 work credits for every year that you work.

The amount that you need to earn each year usually increases a little bit each year to adjust for inflation. These work credits are required in order to receive Social Security Disability Insurance benefits . As a general rule, you remain "insured" for SSDI benefits for about five years after you stop working. This means that if are trying to get SSDI benefits you must show that you became disabled before your insured status expired. This is called your Date Last Insured or DLI. Once you are on SSDI the date last insured is extended automatically.

How Are Work Credits Earned?

Workers can receive a maximum of four work credits each year. The exact amount of work credits you earn each year will depend on your employment activity and the amount of your earnings. In 2024 a worker must earn $1,730 to earn one work credit. In order to qualify for Social Security Disability benefits, you will generally need to have earned a total of 20 work credits, although there are age exceptions to this rule. Once you earn work credits, they stay on your record, so if you become unemployed or change jobs you do not lose the work credits that have earned.

How Many Social Security Credits You Need to Qualify for SSDI

You generally need 40 work credits to qualify for SSDI. 20 of the 40 work credits need to be earned in the last 10 years ending with the year your disability begins. However, the younger you are when you become disabled, the fewer work credits you will need. The rules can get complicated.

You’re disabled and can’t work. You’ve applied for Social Security Disability (SSDI) or Supplemental Security Income (SSI) benefits and got denied.

Unfortunately, the Social Security Administration (SSA) denies almost all initial applications for benefits. But you should not become discouraged. Nor should you just reapply. Instead, what you need to do is appeal that decision but there are strict deadlines to do so.

UNDERSTANDING THE SOCIAL SECURITY APPEALS PROCESS

Request for Reconsideration

The step in the appeals process is called a Request for Reconsideration. When your application for benefits is denied, you’ll have only 60 days to initiate the appeals process by filing a request for reconsideration.

To file a request for reconsideration, you can submit an online form or mail completed form SSA-561-U2 to the Social Security Administration (SSA).

Examiners and consultants who were not involved in your initial request will review your application along with any new information that’s available and make a new decision. Unfortunately, only about 10 percent to 15 percent of those who file a request for reconsideration have their denials reversed.

Hearing by an Administrative Law Judge (ALJ)

If your request for reconsideration is denied, again you’ll have only 60 days to request a hearing with an Administrative Law Judge. It is the job of the ALJ to review decisions made by the SSA to terminate or deny claims for Social Security benefits and make a new determination.

Generally about half of all unfavorable rulings heard by Administrative Law Judges are overturned, however a good lawyer can significantly improve those odds. The hearing before the ALJ is your best opportunity to have your claim approved and get the benefits you need. You should never go in front of an ALJ – or any Judge – without a good lawyer by your side.

However, If your claim is denied by an Administrative Law Judge, you still have the opportunity to appeal the decision.

Appeals Council Review

If an ALJ denies your request for Social Security disability benefits, you can ask the Social Security Administration Appeals Council to review your case. Again, you only have 60 days to file the appeal.

To continue the appeals process, you can request an AppealsCouncil review onlin e or print and mail completed Form HA-520 to the Social Security Administration.

The Appeals Council will look at every request that’s submitted but will “remand” (send back for a new hearing) only a small percentage or overturn an even smaller percentage. That’s why the hearing with the ALJ is the best chance for success.

The Appeals Council looks at an ALJ decision to see if the ALJ made an error of law or violated some procedures. However, the Appeals Council generally gives a lot of respect to the decisions of the ALJ.

Petition to U.S. District Court

The final stage of the Social Security disability appeals process involves filing a civil lawsuit in the Federal Court nearest where you live.

There’s no jury involved when a disability benefits appeal is heard in Federal Court. Instead, the district court Judge reviews the arguments of your attorney and the attorney for the SSA and decides whether or not to send the case back to the Administrative Law Judge for a new hearing.

As a practical matter, your odds of success before a US District Court Judge are near zero without an experienced attorney on the case.

Generally, the federal judge reviews the case to see if there were any mistakes of law, meaning that the law wasn’t interpreted or applied properly. The judge will also consider whether any procedural mistakes were made or that your rights were violated. Judges are human and may also take the facts of your case into consideration during a review, though this is not the standard.

The SSA is making more mistakes and wrongfully denying more claims. “The system has become one of ‘how do we deny this claim’ rather than ‘what is the right answer in this person’s case?’” ... “And the Federal Courts agree: ‘You have to do a better job.’”

What Is the Blue Book?

Officially titled Disability Evaluation Under Social Security, the Blue Book contains a wealth of information pertaining to disabling conditions and criteria that can be helpful when applying for benefits. Social Security examiners, medical professionals, lawyers, and Social Security advocates utilize this book as a tool when evaluating applications for Social Security Disability Insurance or Supplemental Security Income.

The book has three main parts. These parts include:

Part I - General Information: This explains both disability programs Social Security administers. These are the Social Security disability insurance and the Supplemental Security Income program. Part I also provides useful definitions for terms used throughout the process, such as disability and medically determinable impairment, and an outline of the review process and the role of those involved.
Part II - Evidentiary Requirements: This outlines medical evidence required for showing your impairment and its severity. Social Security provides insurance for people with disabilities that prevent them from holding a job. Your Monthly Income

Naturally, your monthly income plays a huge role in determining your monthly SSDI payment. The more you paid into the system through taxes the higher your benefit payment will be. Your cumulative working credits should be at least 40 for you to qualify for the SSDI program. Moreover, you should have accumulated 20 of those credits in the decade immediately before you became disabled.

What Is the Application Process Like?

You can either apply online, through the phone, or in person. Regardless, the application process will follow the following steps.

Hearing Forms

The last forms before your Social Security Hearing – Fill Them Out With Care.

Before being awarded Social Security Disability benefits, most applicants will have to go through an Administrative Hearing. Depending on the backlog in your particular area, you should expect that it will take 12 – 24 months from the time you submit your initial application to be scheduled for a hearing. By the time you receive the Notice of Hearing, you will have a new impairing condition – Form Fatigue.

Form Fatigue is that inescapable condition that results from Social Security’s incessant demands for forms from its applicants. By the time an applicant’s Administrative Hearing is scheduled, he will have been called upon to fill out an Application form, a Request for Administrative Hearing, 2-3 disability forms, 1-2 function report forms, 1-2 work history reports, authorizations and maybe more.

The unfortunate result of Form Fatigue is that by the time the Claimant receives their Hearing Forms, they are tempted to dismiss them or not give them the careful consideration they do require. Succumbing to Form Fatigue is a mistake.

Several months before your hearing date, you will receive your Notice of Hearing , and with it 4 more forms. Most people are so excited to finally have a hearing scheduled they may overlook these forms. They are important, so let’s go through each:

1st: Acknowledgement of Hearing. This one is very simple. All you need do is sign it, check that you will attend your hearing and send it to the OHO(Office of Hearings Operations).

2nd: Recent Medical Treatment: In this form, you are to give detailed contact information for each medical provider you have been treated by since the date you submitted your appeal for hearing and the approximate period of treatment. This includes treatment in hospitals whether it be in-patient or ER visits. Also, you are asked to explain what your doctors have told you about your condition.

[ Attorney Comment: Due to Form Fatigue , many give only the barest of information, and leave off medical providers, ER treatment and critical contact information – addresses and phone numbers.]

3rd: Current Medications: For each prescription and non-prescription medication you currently take, set forth: The reason you take the medication, the dose you take, the approximate date you started taking the medication (if remembered) and the name of the medical provider advising you to take it.

[ Attorney Comment: Due to Form Fatigue , many leave off medications. Check and recheck it. And, while this is not requested, I suggest that you say whether there are any medications your doctors have had you try but that you could not continue with, especially if it is due to drug intolerance, side effects and/or bad interaction with other medications and/or risks regarding other medical problems. For instance, a medication that may be great for depression may cause increased issues of hypertension. You want your attorney and your judge to know that.]

4th: Work Background: Here you are to detail the work, if any, that you have done since submitting your appeal . It is not necessary to repeat information you have provided in earlier forms.

[ Attorney Comment: If you have returned to work, and/or have made a failed work attempt, it is critical that your attorney know about that work as soon as possible. This information will impact the strategy going forward on the case and will require another form…..].

These Claimant Statements/Hearing Forms are important and need to be done with as much accuracy as you can muster. By the time the case is ready for hearing, your file will exceed 300 pages and could easily be as thick as a few thousand pages. The Judge will read your hearing forms for a quick summary of what has been happening with your health in the year or so since the appeal was filed. Depending on your judge’s method of hearing preparation, these forms may be the very first information on your case that your judge sees. First impressions count.

3. Make sure that we get your medical records

As previously said, a solid medical history is the best thing for your Social Security case. Medical records are what make up this history, and therefore it is extremely important that you inform us of when there are new records to collect. It is also important for us to know when you are going to the doctor, as we may have forms or questionnaires for your doctor to complete regarding your case.

4. Refrain from drug and alcohol abuse

Social Security no longer pays benefits if drugs are alcohol are a contributing factor to a disability. If your medical records show drug or alcohol abuse, your case will be denied by Social Security. If you have used drugs or alcohol in the past, it is important that the fact that you have stopped is noted in your medical records.

Rather, you would want to explain how long you can sit in one place before having to readjust, stand up or lay down.

6. Keep in contact with us and the Social Security Administration

Everyday Social Security denies applications for benefits because they are not able to find the applicant. If you move or change your phone number, it is important that you give the new information to Social Security. In the same regard, it is important that we know how to get a hold of you, as we may have forms you need to complete or update information on your claim. We expect to contact you every 60 to 90 days to obtain an update on your medical treatment.

7. Comply with Social Security's requests

Through the decision process, Social Security makes many requests of applicants. It is important that you fill out any paperwork and go to any exams that they request you to go to. If you do not, you may be denied benefits for non-compliance.

8. Keep an eye on your earnings

Social Security has very specific qualifications that must be adhered to in order to qualify for benefits, and a monthly earnings limit is one of the most important. When you are applying for Social Security Disability Insurance, this limit is called SGA (Substantial Gainful Activity). For 2017 the limits are as follows: Non-Blind individual $1170, Blind Individual $1,950. If you are applying for Supplemental Security Income benefits the amount differs depending on marital status but is generally far less.

What Is the Difference Between an Attorney and Non-Attorney Advocate?

The biggest differences between an attorney and a non-attorney advocate (or representative) are their education levels and training.

Attorney. To become an attorney, you must have the following qualifications:

a bachelor’s degree (four-year college degree)
a juris doctorate (J.D.) degree (usually a three-year program of legal studies), and

There are a lot of companies, such as Allsup or SSDC Services which claim to represent you but really protect the interests of the insurance company who may be providing your Long Term or Short Term disability benefits.

How It Works:

Quoting directly from SSDC website is the following:

“SSDC will secure authorization from the LTD recipient to initiate transfer of the LTD plan administrator’s calculated overpayment amount from the recipient’s bank account after the first retroactive SSDI payment has been deposited. After notification of an SSDI award and deposit of funds in the recipient’s account, SSDC will secure verbal confirmation from the recipient to proceed with withdrawal from the account. Periodic contacts by SSDC to remind client of obligation to repay LTD overpayment are mandatory.”

In other words, they, SSDC, Allsup, etc., takes your money and gives it to the insurance company. Sadly, this is legal under the Social Security regulations. Not only do they not have real attorneys representing you, just “advocates,” you will never get to actually meet your “advocate” in person until the day you see the Federal Judge. By then, you will likely have gone through many “advocates” never knowing who is really representing you.

In the end you lose your back benefits. Clearly, SSDC, Allsup and the rest of the companies in the industry have an obvious conflict of interest and not your best interest in mind.

Avoid such companies who claim that they are FREE because in the end it will cost you your back benefits, possibly the entire claim, and then lose your LTD benefits also because a Judge said you were not disabled.
